Legal Notice
On Wednesday, August 16, 2017, the Board of County Commissioners of the County of Clermont, Ohio, adopted Resolution Number 127 -17 declaring the necessity to construct certain improvements for the County Wastewater System in the Clermont County Water Resources Department, Clermont County, Ohio.
The proposed improvements are described as follows:
This project consists of the installation of approximately 11,023 feet of 6” and 8” gravity sewer pipe, 2,801 feet of 2” force main, 52 manholes, 7,200 feet of service laterals, 50 STEP and STEG Collection Systems, and a 57,000 gpd daily average wastewater treatment plant to serve the residents in the Village of Newtonsville and surrounding adjacent area along SR 131, Wright Street, Cedarville Road, Main Street, Cross Street, Newtonsville Road, Never Rest Lane, Amity Road, and Pin Oak Street. The Projects are identified as Project Number 6402-60116 known as the Newtonsville Collection System Assessment Project and Project Number 6402-60117 known as the Newtonsville Wastewater Treatment Plant Project. The cost of the Projects, including construction costs, engineering fees, legal and administrative fees, and all necessary and incidental expenses in connection therewith, is currently estimated at $8,177,171.00, and shall be paid from special assessment (cash payment or certification to the tax bill) of benefited property abutting on the wastewater system improvements or right-of-ways in which they are constructed in the form of a Basic Benefit Assessment with the assessable project costs assessed per benefited front footage, with a 100’ minimum established (total assessable project costs estimated at $4,052,164.00) or General Obligation Bonds or Notes issued in anticipation thereof pursuant to Chapters 6117 and 133 of the Ohio Revised Code, a contribution by the County Waterworks System Capital Improvement Fund (estimated at $1,125,007.00), and grants from the Ohio Public Works Commission (in the amount of $1,000,000.00) and the United States Department of Agriculture (in the amount of $2,000,000.00).
Pursuant to Chapter 6117 of the Ohio Revised Code, notice is hereby given that endorsements of and/or objections to the construction of said improvements, the location, and the estimates of cost and financing, and tentative assessments thereof, all described in said Resolution, will be heard by the Board of County Commissioners at 7:00 P.M. Local Time on Monday, September 25, 2017, at the Pattison Park Lodge located at 2228 US 50, Batavia, Ohio 45103. At such time and place, a public hearing will be granted by such Board of County Commissioners to all interested parties.
A copy of said Resolution, the plans, specifications, estimates of costs and financing, and tentative assessments for such improvements are on file in the Office of the Board of County Commissioners, 101 East Main Street, Batavia, Ohio 45103 and the Office of the Clermont County Water Resources Department, 4400 Haskell Lane, Batavia, Ohio 45103, where they may be examined.
Property owners to be assessed have the right to pay their assessment principal in cash during at least a thirty (30) day period following passage of the resolution levying final assessments, or property owners may pay their assessment over the assessment period, which shall not exceed forty (40) years, at the calculated uniform interest rate necessary to pay assessment bond interest as sold.
Written objections to or endorsements of the proposed improvements, the character and termini thereof, the boundaries of the improvement area, or the estimates of cost and financing, and tentative assessments thereof shall be received by such Board of County Commissioners for a period of five (5) days after such hearing.
